Federal Consistency
Application Notices
The Federal Consistency provision (Section 307) of the Coastal Zone Management Act of 1972 requires that federal actions having reasonably foreseeable effects on any land or water use or natural resource of Ohio’s designated Coastal Management Area be consistent with the enforceable policies of the Ohio Coastal Management Program.
Federal Consistency reviews are conducted by ODNR on behalf of the Ohio Coastal Management Program for proposed Federal actions including permits/licenses, financial assistance to state or local government, and direct Federal agency projects.
Applicants for federal licenses or permits for proposed projects that are located within Ohio’s designated Coastal Management Area (sometimes referred to as the Coastal Zone) must submit a signed Consistency Certification and provide all necessary data and information so ODNR may review the proposed project to determine whether it will be implemented in a manner that is consistent with the Ohio Coastal Management Program’s enforceable policies.
After each Federal Consistency review is complete, ODNR will either issue a Concurrence, Conditional Concurrence or Objection.
- If ODNR issues a Concurrence, then the Federal agency may proceed with the proposed action.
- If ODNR issues a Conditional Concurrence, the Federal agency may proceed with the proposed action if it is amended to include the conditions.
- If ODNR issues an Objection, then the federal agency cannot proceed with the proposed action.
Federal regulations (15 C.F.R. §930.2) require state coastal management programs to include a public comment period as part of the consistency review process.
